Terms of Service for FunDeck

Welcome to FunDeck! These Terms of Service ("Terms") govern your use of the FunDeck mobile application and website (the "Service"), operated by acgames Sp. z o.o. ("we", "us", or "our").

By downloading, accessing, or using FunDeck, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

FunDeck is a digital platform designed to provide parents and guardians with low-prep activity and game ideas for children. The Service includes categorizing activities by energy levels (e.g., "Independent Play" or "Play Together") and an AI-powered feature ("Snap & Play") that generates ideas based on user-uploaded photos of household items.

2. Medical and Safety Disclaimer (Important)

FunDeck provides suggestions, not professional advice. You acknowledge and agree that:

• You are solely responsible for assessing whether an activity is safe and appropriate for your specific child's age, abilities, and environment.
• Activities labeled as "Independent Play" still require a safe environment and appropriate adult supervision from a distance.
• We are not responsible for any injury, property damage, or other harm that may occur while setting up or participating in any activity suggested by the Service.
• FunDeck does not provide medical, developmental, or psychological advice.

3. Subscriptions and Payments

FunDeck offers premium content and features through auto-renewing subscriptions ("FunDeck Premium").

4. User Content and "Snap & Play" Feature

When you use the "Snap & Play" feature, you submit photographs to the Service ("User Content").

• You retain all rights to your User Content.
• By uploading a photo, you grant us a temporary, non-exclusive license to process that image through our third-party AI providers solely to generate activity suggestions.
• Prohibited Content: You agree not to upload photos that contain sensitive personal information, identifiable faces, illegal content, or nudity. We reserve the right to suspend accounts that abuse this feature.

5. Intellectual Property

All original content, features, and functionality of the Service (excluding your User Content), including text, graphics, logos, and the underlying code, are the exclusive property of acgames Sp. z o.o. and are protected by international copyright and trademark laws.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse engineer, decompile, or hack the FunDeck app or its AI features.
• Share your premium account credentials with multiple users.

7. Limitation of Liability

To the maximum extent permitted by applicable law, acgames Sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; or (b) any conduct or content of any third party on the Service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Poland.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
